Terms of Service

These Terms of Service ("Terms") govern your access to and use of the LovelyGen website, platform, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility and Age Requirement

The Service is intended solely for individuals who are at least eighteen (18) years of age. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

You confirm your age by interacting with the age-gate popup on the Service. We rely on your representation. Providing false age information is a material breach of these Terms and may result in immediate termination of access without notice or refund.

2. Description of the Service

LovelyGen provides an experimental artificial intelligence tool that enables users to generate short-form video content by uploading reference imagery and selecting from available generation options. The Service is provided on an "as is" and "as available" basis.

We do not guarantee that any generation will succeed, meet any particular quality standard, or produce any specific result. All outputs are generated algorithmically and may contain unexpected, imperfect, or unintended elements.

You acknowledge that the Service is experimental technology and that results may vary significantly. We make no representations regarding the accuracy, completeness, reliability, or suitability of any generated content.

3. User Accounts

You may be required to create an account to access certain features. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to notify us immediately of any unauthorized use. We reserve the right to suspend or terminate accounts at our sole discretion, with or without notice, for any reason or no reason.

4. User Responsibilities and Uploaded Content

YOU ARE SOLELY AND ENTIRELY RESPONSIBLE FOR ALL CONTENT YOU UPLOAD, SUBMIT, OR GENERATE USING THE SERVICE.

By uploading any image, photo, or other material ("User Content"), you represent and warrant that:

  • You own all rights to the User Content or have obtained all necessary consents, licenses, and permissions (including from any identifiable individuals) to upload and use it with the Service.
  • The User Content does not violate any law, regulation, or third-party rights (including privacy, publicity, intellectual property, or personality rights).
  • No individual depicted in the User Content is under the age of 18, and no content depicts or appears to depict anyone under 18.
  • You have the full legal right to authorize the processing and generation of content based on the User Content.

You agree that LovelyGen has no obligation to monitor, review, or verify any User Content. We may, but are not required to, remove or refuse any content at our sole discretion.

5. Generated Content and License

Subject to these Terms and your full compliance, we grant you a limited, non-exclusive, non-transferable, revocable, non-sublicensable license to download and use the videos generated through your account for your personal purposes.

LovelyGen retains all rights, title, and interest in and to the Service, the underlying technology, models, algorithms, and all related intellectual property. We may use anonymized, aggregated, or derivative versions of outputs (including for improving the Service, research, or promotional purposes) without further notice or compensation to you.

You acknowledge that generated content is produced by artificial intelligence and may not be unique. We do not guarantee that any output will be free from third-party claims.

6. Payments and No Refunds

All purchases of credits, generations, subscriptions, or other paid features are final.

ALL SALES ARE FINAL. NO REFUNDS WILL BE PROVIDED UNDER ANY CIRCUMSTANCES, INCLUDING BUT NOT LIMITED TO DISSATISFACTION WITH RESULTS, TECHNICAL ISSUES ON YOUR END, CHANGE OF MIND, OR FAILURE TO USE CREDITS.

By completing a purchase, you expressly waive any right to chargebacks, disputes, or refund claims to the maximum extent permitted by law. Attempting a chargeback may result in permanent account termination and additional recovery actions.

7. Prohibited Conduct

You agree not to use the Service in any manner that could be considered unlawful, harmful, or abusive. Without limiting the foregoing, you shall not:

  • Upload or generate content involving anyone under 18 years of age (or appearing to be under 18).
  • Upload images of real individuals without their explicit consent for this use.
  • Attempt to reverse-engineer, scrape, or interfere with the Service.
  • Use the Service to create content that violates any applicable law.
  • Misrepresent your identity, age, or authority to upload content.

8. Disclaimer of Warranties

THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, OR RELIABILITY.

We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components. You use the Service at your sole risk.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LOVELYGEN AND ITS OPERATORS, AFFILIATES, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE.

Our total aggregate liability for any claims arising out of or related to these Terms or the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or one hundred US dollars (USD 100), whichever is less.

10. Indemnification

You agree to indemnify, defend, and hold harmless LovelyGen and its operators, officers, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your User Content; (b) your use of the Service; (c) your violation of these Terms; or (d) your violation of any rights of any third party.

11. Termination

We may suspend or permanently terminate your access to the Service at any time, with or without cause or notice, and without liability to you. Upon termination, your right to use the Service ceases immediately, and we may delete your account data (including uploaded faces and generated videos) at our discretion.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to the Service. Your continued use after changes constitutes acceptance. We encourage you to review these Terms periodically.

13. General Provisions

These Terms constitute the entire agreement between you and LovelyGen regarding the Service and supersede all prior agreements.

If any provision is found unenforceable, the remaining provisions will continue in full force. Our failure to enforce any right shall not constitute a waiver.

These Terms shall be governed by and construed in accordance with the laws applicable to LovelyGen, without regard to conflict of law principles.

Any dispute arising out of or relating to these Terms shall be resolved exclusively in the courts having jurisdiction over LovelyGen, and you consent to such jurisdiction.
